These Terms of Use ("Terms") govern your use of the website at https://www.silentearthstudios.com (the "Site"), operated by Silent Earth Studios LLC ("Silent Earth Studios," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms apply to your use of the Site. Your relationship with us as a tattoo client is also governed by the consent, release, and appointment documents you sign in the studio, which control in the event of any conflict with these Terms.

1. Eligibility

The Site is intended for a general adult audience. Tattoo services are available only to adults 18 and older, and you must be 18 or older to book or receive a tattoo. By submitting a booking request, you represent that you are at least 18 years old.

2. Appointments, deposits, and cancellations

We operate by appointment only. Submitting our contact form is a request for a consultation or appointment — it is not a confirmed booking. An appointment is confirmed only when we respond and arrange it with you directly.

Deposit, rescheduling, cancellation, and no-show terms are provided to you at the time of booking and apply to your appointment.

3. Intellectual property

All content on the Site — including tattoo designs, portfolio images, photographs, illustrations, logos, text, and graphics — is owned by Silent Earth Studios, our artists, or our licensors, and is protected by copyright, trademark, and other laws.

You may view and share Site content for personal, non-commercial purposes only. You may not copy, reproduce, republish, distribute, modify, or use our content, designs, or artists' work for any commercial purpose, or to create or have tattooed any design, without our prior written permission.

Custom artwork and tattoo designs created by our artists remain the intellectual property of the artist who created them, unless we agree otherwise in writing.

4. Your submissions

When you submit information or materials through the Site — such as reference images, descriptions, or messages in our contact form — you confirm that you have the right to share them and that doing so does not violate anyone else's rights. You grant us permission to use the materials you submit for the purpose of responding to your request and preparing for your consultation or appointment.

If you tag us or share content featuring our work on social media, you grant us permission to repost or share that content with credit, unless you tell us otherwise.

5. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site or its systems;
• Scrape, harvest, or collect data from the Site by automated means; or
• Interfere with the Site's operation or security, or upload anything harmful or malicious.

6. Aftercare and other information

Information on the Site, including tattoo aftercare guidance, FAQs, and blog content, is provided for general informational purposes only. It is not medical advice and is not a substitute for professional care. If you experience signs of infection, an allergic reaction, or any other medical concern, consult a qualified healthcare provider.

7. Third-party links and services

The Site links to third-party services we do not control, including our Etsy store, our Instagram profile, and embedded social content. We are not responsible for the content, products, or practices of these third parties. Merchandise purchases are made through Etsy and are governed by Etsy's own terms and policies. Your use of any third-party service is at your own risk.

8. Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Silent Earth Studios and its owners, artists, and staff will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Site. This section does not limit any rights that cannot be limited under applicable law. Nothing in these Terms affects the separate consent and release documents that govern tattoo services performed in the studio.

10. Indemnification

You agree to indemnify and hold harmless Silent Earth Studios and its owners, artists, and staff from any claims, damages, or expenses arising out of your misuse of the Site or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be handled in the state or federal courts located in Multnomah County, Oregon.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we'll revise the "Effective date" above and post the updated version on this page. Your continued use of the Site after changes take effect means you accept the updated Terms.
